Personal injury settlements are calculated using one of two primary methods:

Multiplier method: Total Economic Damages \u00d7 Severity Multiplier = Gross Settlement

Per diem method: Economic Damages + (Daily Rate \u00d7 Recovery Days) = Gross Settlement

Then: Gross \u2192 Fault Reduction \u2192 Attorney Fee \u2192 Net Settlement

Example: $25,000 medical + $8,000 wages = $33,000 economic. Moderate injury (4x) = $132,000 gross. 10% fault in NY (pure comparative) = $118,800. After 33.3% attorney fee = ~$79,200 net.

What is the multiplier method?

The multiplier method calculates a settlement by multiplying total economic damages (medical bills + lost wages) by a severity factor. Minor injuries use 1.5–3x, moderate injuries 3–5x, serious injuries 5–8x, and catastrophic injuries can be 15–25x or higher.

What is the per diem method?

The per diem ("per day") method assigns a daily dollar amount to pain and suffering, then multiplies by the number of recovery days. A common daily rate equals your daily earnings. This method is often used for temporary injuries with clear recovery timelines.

How does comparative negligence work?

Comparative negligence reduces your settlement based on your fault percentage. Pure comparative states (CA, NY, FL) allow recovery even at 99% fault. Modified 50% states bar recovery at 50%+ fault. Modified 51% states bar at 51%+. Contributory states (AL, MD, NC, VA, DC) bar any recovery if you’re even 1% at fault.
